第一部分: 出国前特别提醒

Section I: Special Reminders before Going Abroad

一、 登录外交部网站和中国领事服务网,查询中国各驻外使、领馆的联系方式以及相关旅行提醒、警告等海外安全信息。若目的地国与我国无外交关系,则可了解其周边国家的中国使、领馆的地址与电话,以便就近求助。

1. Get on the website of the Ministry of Foreign Affairs and the website of China Consular Affairs to inquire the contact information of Chinese embassies and consulates in various countries and relevant travelling reminders, warnings and other overseas security information. If the destination country has no diplomatic relation with China, the addresses and telephone numbers of the Chinese embassies and consulates in the neighboring countries may be learned to seek help nearby.

二、检查护照有效期(剩余有效期一般应在一年以上),以免因护照有效期不足影响申请签证,或在国外期间因护照过期影响行程。

2. Check the date of expiration of the passport (the remaining term of validity shall be more than one year generally) in case the remaining term is not long enough, where the visa application is impacted or the travel is impacted during the overseas stay.

三、办妥目的地国签证。确保自己已取得目的地国的入境签证和经停国家的过境签证,签证种类与出国目的相符,签证的有效期和停留期与出行计划一致。但需要注意的是,根据国际惯例,即使您已取得一国签证,该国也有权拒绝您入境而无需说明理由。

3. Arrange the destination country visa. Make sure that you have obtained the entry visa of the destination country and the transit visa of the transit country, that the visa class is in conformity withthe purpose of going abroad, and that the term of validity of the visa is in conformity with the travel plan. What needs to be noticed is that according to international common practice, even if you have obtained the visa of a country, such country still has the right to reject your entry without giving any reason.

四、核对机(车、船)票。仔细核对票面上所显示的登机(车、船)时间、地点以及联程票的前后衔接是否正确。

4. Check the air (train, bus, and steamer) ticket and see if the boarding times and spots on the tickets and the connections of the connection tickets are correct.

五、了解您的旅行目的地国。尽可能收集目的地国的风土人情、气候情况、治安状况、艾滋病、流行病疫情、法律法规等信息,并采取相关预防措施。

5. Study the destination country of your travel, try to learn the information on local customs and practices, climatic conditions, public security conditions, AIDS situation, epidemic disease situation, and laws and regulations, and take relevant preventive actions.

六、购买必要的人身安全和医疗等方面保险。您将要面对国外陌生的环境,存在一些安全方面的隐患,而国外医药等费用普遍较高,建议您选择合适的险种,以防万一。

6. Buy necessary insurances for personal security, medical treatment, and other aspects. You are about to be in an unfamiliar environment overseas where there might be hidden danger of security and since the medicament prices abroad are generally higher, you are advised to choose an appropriate insurance type, just in case.

七、进行必要的预防接种,并随身携带接种证明(俗称黄皮书)。

7. Have necessary preventive vaccination and take the vaccination certificate along (commonly known as the “yellow book”).

八、有条件的话,最好做一次全面体检。

8. If possible, a comprehensive medical examination is suggested.

九、严禁携带毒品、国际禁运物品、受保护动植物制品及前往国禁止携带的其他物品等出入境。

9. Carrying drugs, internationally embargoed articles, protected animals and plants, and other articles prohibited by the destination country for departure and entry are strictly prohibited.

十、慎重选择携带个人药品。许多国家对药品入境有严格规定,为减少不必要的麻烦,出国前应了解有关国家的海关规定,在允许的范围内选择所携药品的品种和数量。

10. Carefully choose personal medicines to be carried along. Many countries set strict rules for medicine entry. Therefore, to minimize unnecessary troubles, you should learn customs regulations of the relevant country and carry medicines of which the types and quantities are within the allowed range.

十一、如因治疗自身疾病必须携带某些药品时,应请医生开具处方,并备齐药品的外文说明书和购药发票。

11. If certain medicines must be carried for disease treatment, ask the doctor to write out a prescription, and prepare all the package inserts in foreign language and the invoices for medicine purchase.

十二、注意目的地国海关在食品、动植物制品、外汇等方面的入境限制。如携带大额现金,必须按规定向海关申报。切勿为陌生人携带行李或物品。

12. Pay attention to the entry restrictions of the destination country customs in the aspects of food, animal and plant products, foreign exchange. If a large amount of cash is taken along, declaration must be made to the customs. Do not carry baggage or articles for strangers.

十三、与家人和朋友保持联系。出国前应给家人或朋友留下一份出行计划日程,约定好联络方式。建议您在护照上详细写明家人或朋友的地址、电话号码,以备紧急情况下有关部门能够及时与他们取得联系。护照、签证、身份证应复印,一份留在家中,一份随身携带,还要准备几张护照相片,以备不时之需。

13. Keep in touch with family members and friends. A travel plan should be left to the family members or friends before going abroad to agree on the contact information. You are advised to notice the address and phone number of your family member or friend on your passport so that relevant department can get in touch with them in emergency. The passport, visa, and ID card shall be photocopied with one copy left at home and another taken along. A few passport photos shall be prepared for unexpected needs.

十四、尊重当地风俗习惯,遵守当地法律规定,注意交通安全(在实行靠左行驶的国家应尤其注意)。

14. Respect local manners and customs, abide by local laws and regulations, and pay attention to traffic safety (pay more attention in countries of left-side driving).

十五、严格按照签证或居留许可上允许的时间在有关国家停留。

15. Stay in the relevant country only for the time as allowed on the visa or resident permit.

第二部分: 出国后特别提醒

Section II: Special Reminders after Going Abroad

一、 如您需在国外停留较长时间或所在国局势不稳,建议您在中国驻当地使、领馆进行公民登记,以便出现紧急情况时,使、领馆能及时与您取得联系。

1. If you need to stay abroad for a comparatively long time or the country where you are is in an unstable situation, you are advised to do the citizenship registration at the local Chinese embassy and consulate so that you can be contacted immediately in emergency.

二、注意防盗、防骗、防诈、防抢、防打。在住处不要给陌生人开门;不要让小孩告诉陌生人父母不在家;出门时尽量不要随身携带贵重物品或大量现金,也不要在居住地存放大量现金;不要在私车的明处摆放贵重物品,如车胎被扎,修车时务必要先锁好车门;不要将文件、钱包、护照等重要物品放在易被利器划开的塑料袋中;不要在黑暗处招呼出租车;不要轻易让陌生人搭乘您的车;不要和陌生人一起行走;在公共场合要表现平静,不要大声说话,避免突出自己;不要在公共场所参与他人的争吵;不要在街上乱捡东西,以防被敲诈;不要在黑市上换汇;如警察检查您的护照等证件,应先请他出示证件,记下他的警牌号、警车号;交罚款时不要当街交给警察,而要凭罚款单交到银行等指定地点。

2. Pay attention to theft, cheat, fraud, robbery, and assault. Do not open the door for strangers; do not let the children tell the strangers that their parents are not home; try not to take valuables or a large amount of cash when going out, or keep a large amount of cash at where you live; do not place valuables at a prominent spot in your car; if the tire is punctured, make sure to lock up the vehicle door before fixing it; do not put documents, wallet, passport and other important articles in a plastic bag that is easily to be cut open by an edge tool; do not hail a taxi in dark places; do not simply offer a ride to strangers; do notwalk with strangers; keep calm in public places and do not speak loudly which will make yourself stand out; do not argue with others in public places; do not pick up random things on the street in case of blackmail; do not do exchange money on black market; if a policeman checks your passport or other documents, ask him to show his certificate first and memorize his card number and police car number;do not hand the fine to the police out on the street, but pay the money to the bank or at the place designated on the ticket instead.

三、如发生被抢、被盗、被骗或被打事件,应立即向当地警方报案,并要求其出具报警证明,以便日后办理保险理赔、证件补发等手续。

3. In case of robbery, theft, cheat or assault, report the case to the local police immediately and ask for issuance of certificate for convenience of handling insurance claims, document reissue and so on.

四、留意当地报纸、电视等媒体信息,了解当地政治、经济、社会形势,与邻为善,入乡随俗,尽快适应当地生活,融入当地社会。

4. Pay attention to information on the local newspapers, televisions and other media to get to know the local political, economic, and social situation, be friendly to the neighbors, follow the local customs and practices, and adapt to the local society.

五、您的合法权益受到侵害时,应循正当途径解决,不要采取贿赂等不合法方式。

5. When your legitimate rights and interests are infringed, address the problem with a proper approach instead of bribery or other illegal approaches.

六、熟记当地火、警、急救等应急电话。

6. Memorize the emergency telephone numbers for fire, police and first aid.

七、照顾好自己的身体。注意在外饮食健康,尽量避免吃未煮熟的食物或喝未煮开的水(除正规密封矿泉水);切勿前往疫区、辐射区、赌博、色情等场所。

7. Take care of yourself. Pay attention to your food and health and try to avoid eating undercooked food or drinking unboiled water (regular sealed mineral water excluded); do not go to epidemic areas, radiated areas, and eroticplaces.

八、通过电话或电子邮件等与家人或朋友保持正常联络,以免亲友担忧。

8. Keep in normal touch with family members or friends via telephone or email in case relatives and friends get worried.

第三部分: 领事官员可以为您做什么

Section III: What the Consular Officers Can Do for You

一、 当您的合法权益在所在国受到侵害,或与他人发生民事纠纷,或涉及刑事案件,中国驻外使、领馆可以应您的请求推荐律师、翻译和医生,帮助您进行诉讼或寻求医疗救助。

1. When your legitimate rights and interests are infringed, oryou have a civil dispute with others, or your are involved in a criminal case, the Chinese embassy or consulate in this country can recommend lawyers, interpreters and doctors as requested by you to help you to institute the preceding or seek medical assistance.

二、可以在所在国发生重大突发事件时,为您撤离危险地区提供咨询和必要的协助。

2. When there is a major incident in the country where you are, they can provide consulting service and necessary assistance for your evacuation from the hazardous area.

三、可以在您被拘留、逮捕或服刑时,根据您的请求进行探视。

3. They can visit you as you request when you are detained, arrested or serving you sentence.

四、可以在您遭遇意外时,协助您将事故或损伤情况通知国内亲属。

4. They can help you inform your domestic relatives of the accident or the damage situation when an accident happens to you.

五、可以在您遇到生计困难时,协助您与国内亲属联系,以便及时解决费用问题。

5. They can help you get in touch with your domestic relatives when you have livelihood difficultiesso that you can solve the financial problems as soon as possible.

六、可以协助您寻找失踪或久无音讯的亲友。您提出请求时须提供被寻人员的详细信息。

6. They can help you look for relatives and friends that have disappeared or you haven’t heard from in a long time. You must provide detailed information of the people to be sought when proposing the request.

七、可以根据中华人民共和国有关法律和法规为在国外合法居留的中国公民颁发、换发、补发旅行证件及对旅行证件上的相关资料办理加注。

7. They can issue, renew, or reissue the travel documents and handle the annotation on the travel documents for Chinese citizens with legal residence abroad in accordance with relevant laws and regulations of the People’s Republic of China.

八、可以为遗失旅行证件或无证件的中国公民签发旅行证或回国证明。

8. They can issue travel document or return certificate for Chinese citizens that have lost their travel document or that have no document.

九、可以根据中华人民共和国有关法律、法规和相关国际条约为中国公民办理有关文件的公证、认证;在与所在国的法律规章不相抵触的情况下办理中国公民间的婚姻登记手续(注:不能直接认证中国国内公证机关出具的公证书,也不能为中国国内有关机关出具的其他证书或文书办理公证)。

9. They can handle the notarization and certification of relevant documents for Chinese citizens in accordance with the laws and regulations of the People’s Republic of China; they can handle the registration procedures for marriages between Chinese citizens under the circumstance where no laws or regulations of the local country are violated (note: they cannot directly certify the notarial deedissued by a Chinese domestic public notary office, nor handle the notarization for other certificates or instruments issued by a Chinese domestic organ concerned).

第四部分: 领事官员不可以为您做什么

Section IV: What the Consular Officers Cannot Do for You

一、 不可以为您申办签证。

1. They cannot apply for the visa for you.

二、不可以为您在当地谋职或申办居留证、工作许可证。

2. They cannot look for a job for apply for the residence permit and work permit for you.

三、不可以干预所在国的司法或行政行为。

3. They cannot intervene in the judicial act or administrative act of the local country.

四、不可以参与仲裁或解决您与他人的经济、劳资和其他民事纠纷。

4. They cannot take part in the arbitration or address the economic dispute and labor dispute between you and others or other civil disputes.

五、不可以替您提出法律诉讼。

5. They cannot file a legal proceeding for you.

六、不可以帮助您在治疗、拘留或监禁期间获得比当地人更佳的待遇。

6. They cannot help you get treatment better than that for the local people when you are under medical treatment, in detention or jail.

七、不可以为您支付酒店、律师、翻译、医疗及旅行(机、船、车票)费用或任何其他费用。

7. They cannot pay the fees for accommodation, attorney, translation, medical treatment or traveling (air tickets, steamer tickets, and bus or train tickets) or any other fees.

八、不可以将您留宿在使、领馆内或为您保管行李物品。

8. They cannot accommodate you in the embassy or the consulate or keep the baggage and articles for you.

九、不可以为您购买免税物品。

9. They cannot purchase duty-free articles for you.

第五部分: 寻求领事保护的常见问题

Section V: FAQ on Consular Protection

一、 什么是领事保护?

1. What is consular protection?

领事保护是指中国公民、法人的合法权益在所在国受到侵害时,中国驻当地使、领馆依法向驻在国有关当局反映有关要求,敦促对方依法公正、妥善处理,从而维护海外中国公民、法人的合法权益。

Consular protection means when the legitimate rights and interests of Chinese citizens and legal persons are infringed in the local country, the Chinese embassy and consulate in the local country will report relevant requests to relevant organs of the local country, and urge them to handle the requests impartially and properly according to law so as to stand up for the legitimate rights and interests of Chinese citizens and legal persons abroad.

实施领事保护的主体是政府,在国外是驻外使领馆。中国目前有260多个驻外使领馆,他们都是实施领事保护的主体。

The subject that implements consular protection is the government, and the embassies and consulates abroad. Currently, China has more than 260 embassies and consulates in other countries which are all the subjects that implement consular protection.

领事保护的内容是海外中国公民、法人在海外的合法权益。合法权益主要包括:人身安全、财产安全、合法居留权、合法就业权,法定社会福利、人道主义待遇等,以及当事人与我国驻当地使领馆保持正常联系的权利。

The contents of consular protection are the legitimate rights and interests of Chinese citizens and legal persons abroad. The legitimate rights and interests mainly include personal security, property security, legitimate right of residence, legitimate right of employment, legal social welfare, humanitarianism treatment, as well as the right of the party involved to keep normal contact with the embassy and consulate in the local country.

领事保护的方式主要是依法依规,向驻在国反映有关要求,敦促公平、公正、妥善地处理。依据的法规,主要包括公认的国际法原则、有关国际公约、双边条约或协定以及中国和驻在国的有关法律。

The approach of consular protection is mainly to report relevant requests to the country of residence, and urge them to handle the requests fairly, impartially, and properly. The laws and regulations based on mainly include the recognized principles of international law, relevant international convention, bilateral treaty or agreement, and the laws of China and of the country of residence.

二、什么人可以得到中国政府的领事保护?

2. Who can get the consular protection by the Chinese government?

凡是依照《中华人民共和国国籍法》具有中国国籍者,都可以得到中国政府的领事保护。也就是说,只要您是中国公民,无论是定居国外的华侨,还是临时出国的旅行者;无论是大陆居民,还是香港、澳门和台湾同胞,都是我们提供领事保护的对象。

Anyone that has Chinese nationality in accordance with the Nationality Law of the People’s Republic of China can get the consular protection by the Chinese government, i.e. as long as you are a Chinese citizen, whether you are Chinese living abroad or travelers temporarily abroad, whether you are from the mainland, or Hong Kong, Macao or Taiwan, you are the objects of the consular protection we provide.

Note1: Relevant content of the Explanation by NPC Standing Committee of a Few Questions on the Implementation of the Nationality Law of the People’s Republic of Chinain HongKongSpecialAdministrative Region:

(1) 凡具有中国血统的香港居民,本人出生在中国领土(含香港)者,以及其他符合《中华人民共和国国籍法》规定的具有中国国籍的条件者,都是中国公民。

All Hong Kong residents with Chinese descent, those that were born within the territory of China (including Hong Kong), and others that have Chinese nationality as set out in the Nationality Law of the People’s Republic of China are Chinese citizens.

(2) 所有香港中国同胞,不论其是否持有英国属土公民护照或者英国国民(海外)护照,都是中国公民。自199771日起,上述中国公民可继续使用英国政府签发的有效旅行证件去其他国家或地区旅行,但在香港特别行政区和中华人民共和国其他地区不得因持有上述英国旅行证件而享有英国的领事保护的权利。

All Chinese compatriot from Hong Kong, whether they hold “British dependent territories citizen passports” or “United Kingdom nationals (overseas) passports”, are Chinese citizens. Starting from July 1, 1997, the Chinese citizens aforesaid may continue to use the valid travel documents issued by the British government to travel to other countries or regions, but the people from Hong Kong Special Administrative Region and other regions of the People’s Republic of China cannot have the right to get consular protection of the United Kingdom because they hold the British travel document aforesaid.

(3) 任何在香港的中国公民,因英国政府的居英权计划而获得的英国公民身份,根据《中华人民共和国国籍法》不予承认。这类人仍为中国公民,在香港特别行政区和中华人民共和国其他地区不得享有英国的领事保护的权利。

Any Chinese citizen in Hong Kong that have obtained British citizenship according to “British Nationality Selection Scheme” by the British government will not be recognized according to the Nationality Law of the People’s Republic of China. Such people are still Chinese citizens, and may not be entitled with the right to get consular protection by the United Kingdom in Hong Kong Special Administrative Region and other regions of the People’s Republic of China.

(4) 在外国有居留权的香港特别行政区的中国公民,可使用外国政府签发的有关证件去其他国家或地区旅行,但在香港特别行政区和中华人民共和国其他地区不得因持有上述证件而享有外国领事保护的权利。

The Chinese citizens from Hong Kong Special Administrative Regions that have the right of residence in other countries may use relevant documents issued by the foreign governments to travel to other countries or regions, but Hong Kong Special Administrative Region and other regions of the People’s Republic of China may not have the right to get foreign consular protection because they hold the documents aforesaid.

(5) 香港特别行政区的中国公民的国籍发生变更,可凭有效证件向香港特别行政区受理国籍申请的机关申报。

In case the nationality of a Chinese citizen in Hong Kong Special Administrative Region changes, application may be proposed to the organ that handles nationality application in Hong Kong Special Administrative Region by virtue of a valid document.

2:《全国人民代表大会常务委员会关于〈中华人民共和国国籍法〉在澳门特别行政区实施的几个问题的解释》的有关内容:

Note2: Relevant content of the Explanation by NPC Standing Committee of a Few Questions on the Implementation of the Nationality Law of the People’s Republic of China in Macao Special Administrative Region:

(1) 凡具有中国血统的澳门居民,本人出生在中国领土(含澳门)者,以及其他符合《中华人民共和国国籍法》规定的具有中国国籍的条件者,不论其是否持有葡萄牙旅行证件或身份证件,都是中国公民。凡具有中国血统但又具有葡萄牙血统的澳门特别行政区居民,可根据本人意愿,选择中华人民共和国国籍或葡萄牙共和国国籍。确定其中一种国籍,即不具有另一种国籍。上述澳门特别行政区居民,在选择国籍之前,享有澳门特别行政区基本法规定的权利,但受国籍限制的权利除外。

All Macao residents with Chinese descent, those that were born within the territory of China (including Macao), and others that have Chinese nationality as set out in the Nationality Law of the People’s Republic of China, whether they hold Portuguese travel documents or ID cards, are Chinese citizens. All residents in Macao Special Administrative Region that have Chinese descent and Portuguese descent may, as they wish, choose the nationality of the People’s Republic of China or the nationality of the Portuguese Republic. Once a nationality is confirmed, the other does not exist. The residents in Macao Special Administrative Region aforesaid, before choosing their nationality,are entitled to the rights set out in the fundamental law of the Macao Special Administrative Region without the right limited by nationality excluded.

(2) 凡持有葡萄牙旅行证件的澳门中国公民,在澳门特别行政区成立后,可继续使用该证件去其他国家或地区旅行,但在澳门特别行政区和中华人民共和国其他地区不得因持有上述葡萄牙旅行证件而享有葡萄牙的领事保护的权利。

All Chinese citizens from Macao that hold Portuguese travel document, after the establishment of Macao Special Administrative Region, may continue to use such documents to travel to other countries or regions, but the people from Macao Special Administrative Region and other regions of the People’s Republic of China cannot have the right to get consular protection of Portugal because they hold the Portuguese travel document aforesaid.

(3) 在外国有居留权的澳门特别行政区的中国公民,可使用外国政府签发的有关证件去其他国家或地区旅行,但在澳门特别行政区和中华人民共和国其他地区不得因持有上述证件而享有外国领事保护的权利。

The Chinese citizens from Macao Special Administrative Regions that have the right of residence in other countries may use relevant documents issued by the foreign governments to travel to other countries or regions, but Macao Special Administrative Region and other regions of the People’s Republic of China may not have the right to get foreign consular protection because they hold the documents aforesaid.

(4) 在澳门特别行政区成立以前或以后从海外返回澳门的原澳门居民中的中国公民,若变更国籍,可凭有效证件向澳门特别行政区受理国籍申请的机关申报。

For the Chinese citizens among the original Macao residents that come back from abroad before or after the establishment of the Macao Special Administrative Region, in case their nationalities are to be changed, application may be proposed to the organ that handles nationality application inMacao Special Administrative Region by virtue of a valid document.

三、出国时持中国护照,现已取得居住国国籍,是否还能享有中国驻当地使、领馆的领事保护?

3. I held the Chinese passport when I went abroad, but now I have obtained the nationality of the country where I live. Can I still be entitled to the consular protection by the Chinese embassy and consulate in the country?

根据《中华人民共和国国籍法》规定,中国不承认中国公民具有双重国籍。定居外国的中国公民,凡自愿加入或取得外国国籍者,即自动丧失中国国籍,因而不再享有中国驻外使、领馆的领事保护。

According to the provisions under Nationality Law of the People’s Republic of China, China does not recognize dual nationalities. For the Chinese citizens that settle down in another country, once they apply for naturalization or obtain the nationality of that country voluntarily, they lose the Chinese nationality automatically, hence are not entitled to the consular protection by the Chinese embassy and consulate.

四、正在办理移民者,是否还能享有中国驻当地使、领馆的领事保护?

4. I am handling the migration. Can I still be entitled to the consular protection by the Chinese embassy and consulate in the country?

正在办理移民手续者,在手续完结、国籍变更之前仍是中国公民,是我们提供领事保护的对象。

For those that are handling migration, they are still Chinese citizens before the completion of procedures and the change of the nationality and are the objects of consular protection we provide.

五、中国公民在何种情况下可以获得领事保护?

5. In what case can a Chinese citizen get consular protection?

根据《维也纳领事关系公约》第五条规定:领事职务包括于国际法许可之限度内,在接受国内保护派遣国及其国民——个人与法人——之利益帮助及协助派遣国国民——个人与法人等。也就是说,中国公民在其他国家境内的行为主要受国际法及所在国当地法律约束。一旦中国公民(包括触犯当地法律的中国籍公民)在当地所享有的合法权益受到侵害,中国驻外使、领馆有责任在国际法及当地法律允许的范围内实施领事保护。

According to Article 5 under Vienna Convention on Consular Relations, the functions of a consul include: to the extend as allowed under the International Law, toprotect the interest of the sending state (individuals and legal persons) within the accepting state; to help and assist the sending state (individuals and legal persons), etc., i.e. the acts of a Chinese citizen in other countries are mainly subject to the International Law and the laws of that country. Once the legitimate rights and interests of Chinese citizens (including the Chinese citizens that have violated the local law) at the place are infringed, the Chinese embassy and consulate have the responsibility to implement consular protection within the scope as allowed by the International Law and the local laws.

六、中国公民怎样能获得中国政府的领事保护?在寻求领事保护时应注意些什么?
